Agreeing to these terms
These terms cover your use of the C&M Tyler Concrete and Masonry website and any estimate, scheduling or work you arrange with us. When you browse the site, call us or ask for a quote, you're agreeing to them, so please read them before you book.
If you sign a written estimate or contract with us, that document controls the specific job. Where it says something different from this page, the signed document wins.
What we do
C&M Tyler Concrete and Masonry is a masonry contractor in Tyler, TX. We do brick, block, stone and concrete work for homeowners in Tyler and the cities around it, including repairs, new walls, chimneys, fireplaces, pavers and walkways. The full list is on our home page, and you can read more about our crew on the about page.
We're licensed and insured. The information on this website is general and meant to help you understand the work. It isn't an engineering opinion or a guarantee about your property, because we can't judge a wall, chimney or foundation until we've seen it in person.
Estimates and pricing
Quotes are free and done on site, and there's no pressure to book. Your written estimate lists the work, the materials and the price, and it's good for the period written on it, because material costs change.
An estimate is based on what we can see. Once a job is open we sometimes find things nobody could see from outside, like damaged brick behind a face, rotted backing, loose footings or soil problems. When that happens we stop, show you what we found and explain the options, and we don't do added work or charge for it until you approve it in writing.
Changes you ask for after the job starts, such as a different brick, a longer wall or a new pattern, are priced and approved in writing before we do them.
Scheduling, weather and cancellation
We give you a start date and a rough timeline with your estimate. Masonry and concrete depend on the weather, so heavy rain, freezing temperatures or extreme heat can push work back, because mortar and concrete need the right conditions to cure properly. We'll tell you as soon as we know a date is moving.
If you need to cancel or reschedule, call us as early as you can. Materials we've already ordered or had made for your job, and work we've already done, may still be charged, as your written estimate explains.
Payment
Payment terms, including any deposit and when the balance is due, are written in your estimate or contract before work starts. Unless that document says otherwise, the final balance is due when the work is finished.
If a payment is late, we may pause work until the account is current. You're responsible for reasonable costs of collecting an unpaid balance, to the extent Texas law allows.
Your part of the job
We ask you to give our crew safe access to the work area, keep pets and children clear of it, and tell us about anything buried or hidden that we can't see, such as sprinkler lines, private gas or electric lines, septic parts and property lines. We can't be responsible for damage to items we weren't told about and couldn't reasonably have known were there.
If the job needs a permit or approval from the city or your homeowners association, your written estimate says who is getting it.
Workmanship and warranty limits
We stand behind our work, and any warranty on your job is the one written in your estimate or contract. Materials like brick, stone, pavers, block and fireplace units carry their makers' warranties, which we pass along to you.
Masonry is a natural material, so some things aren't defects. Brick and stone vary in color and texture, new mortar on an older house rarely matches perfectly at first, and concrete can show small hairline cracks as it cures and shrinks. Our warranty doesn't cover damage from ground movement, drainage problems we didn't build, storms, impact, misuse, or later work by someone else.
Except for the written warranty on your job, and to the extent Texas law allows, our work and this website are provided without other warranties, express or implied.
Limits on liability
To the extent Texas law allows, C&M Tyler Concrete and Masonry isn't liable for indirect or consequential losses, such as lost use of a room, lost rent or delays to other projects. Our total liability for any job is limited to the amount you paid us for that job.
Nothing on this page limits rights you have under Texas law that can't be waived.
If something goes wrong
Most problems get solved with a phone call, so call us first at (903) 525-6451 and we'll come look. If we can't settle it together, we both agree to try mediation in good faith before going to court, though either of us can still use small claims court for a claim that qualifies.
These terms are governed by the laws of the State of Texas. Any lawsuit about them or about our work will be brought in a Texas court that serves the area where the work was done.
Changes to these terms
We may update this page from time to time. The version posted here when you sign your estimate is the one that applies to your job, and later changes won't affect a signed agreement unless we both agree in writing.
